Kansas domestic animal activity warning:
WARNING Under Kansas law, there is no liability for an injury to or the death of a participant in domestic animal activities resulting from the inherent risks of domestic animal activities, pursuant to K.S.A. 60-4001 through 60-4004. You are assuming the risk of participating in this domestic animal activity.
Inherent risks of domestic animal activities include, but shall not be limited to: (1) The propensity of a domestic animal to behave in ways, i.e., running, bucking, biting, kicking, shying, stumbling, rearing, falling or stepping on, that may result in an injury, harm or death to persons on or around them; (2) the unpredictability of a domestic animal’s reaction to such things as sounds, sudden movement and unfamiliar objects, persons or other animals; (3) certain hazards such as surface and subsurface conditions; (4) collisions with other domestic animals or objects; and (5) the potential of a participant to act in a negligent manner that may contribute to injury to the participant or others, such as failing to maintain control over the domestic animal or not acting within such participant’s ability. This notice concerns the domestic animal activity statute; it does not eliminate exceptions or duties imposed by law.
Activities and risks:
“Activities” include entering or being on Shy 38 Inc.’s property; visiting, tours, events, educational activities, and photography; volunteering, construction, repair, cleaning, feeding, gardening, animal care, or other work; and being near, observing, touching, feeding, or handling animals. Activities may occur around cows, pigs, goats, sheep, horses, miniature horses, chickens, ducks, geese, dogs, and other animals. Participation may involve farm buildings, pens, pastures, barns, fences, gates, tools, equipment, vehicles, and outdoor areas.
I understand that these activities involve known and unknown risks, including serious injury, illness, disability, death, or property loss. Risks include animal bites, pecks, scratches, kicks, head-butting, crushing, trampling, being knocked down, startled or unpredictable animal movement, animal escape, and contact with animals that are sick, injured, protective, or unfamiliar. Other risks include uneven, muddy, wet, icy, or manure-covered ground; holes, rocks, fencing, wire, gates, low or overhead structures; tools and machinery; lifting and repetitive work; falling objects; dust, hay, mold, insects, weather, heat, cold, lightning, and dehydration; infectious disease and zoonotic exposure; allergies; and acts or omissions of other people.
I understand that Shy 38 Inc. cannot eliminate all risks inherent in animal and farm activities. I choose to participate voluntarily, accept the risks of injury, illness, death, and property damage, and agree to follow instructions and posted rules. I will not enter an animal enclosure, touch or feed an animal, use equipment, or perform a task unless authorized and instructed to do so.

Release of claims:
In exchange for permission to enter the property or take part in Activities, I, for myself and my heirs, estate, personal representatives, and assigns, release and agree not to sue Shy 38 Inc., the property owner(s), and each of their directors, officers, employees, agents, and authorized volunteers (together, the “Released Parties”) for claims for personal injury, illness, death, or property damage arising out of or connected with my presence or participation, including claims caused in whole or in part by the ordinary negligence of a Released Party, to the fullest extent permitted by Kansas law. This includes ordinary negligence concerning premises conditions, animal handling or control, instructions, supervision, equipment, or failure to warn of a risk.
This release does not apply to claims that Kansas law does not allow a person to waive, including claims arising from gross negligence, willful, wanton, or intentional misconduct, or any other nonwaivable legal duty. Nothing in this form changes any protection, exception, or limitation provided by applicable Kansas law.
Personal property and responsibility:
I am responsible for my own belongings and for damage I cause through my intentional or reckless conduct. I will not be responsible under this form for a Released Party’s own negligence. I understand that Shy 38 Inc. does not provide personal accident, health, or property insurance for visitors or volunteers, unless it separately informs me in writing that a specific policy applies.

Follow all instructions from Shy 38 Inc. staff or the volunteer lead. Stop work and report any injury, unsafe condition, escaped animal, or animal behavior concern promptly.
Stay in authorized areas; close and latch gates; never prop open a gate or enter an enclosure without permission. Do not chase, corner, lift, ride, startle, or feed animals unless specifically instructed.
Wear sturdy closed-toe shoes and clothing suitable for outdoor farm work. Use any safety equipment provided and do not use tools, machinery, ladders, vehicles, or powered equipment unless authorized and trained.

If I am injured or become ill and cannot provide instructions, I authorize Shy 38 Inc. to contact emergency services and request reasonable emergency assistance. I understand that Shy 38 Inc. is not providing medical care and that I am responsible for medical, ambulance, and related expenses. I consent to emergency first aid by a person who reasonably believes it is appropriate, while understanding that no person is required to provide treatment.
